Sex with an underage girl may constitute statutory rape. The severity of the charge and potential penalties depends in part on the relative maturity of the parties. For example, if the accused is 10 or more years older than the victim, the charge may be a felony.

The word statutory means that force was not necessarily used. Consent may even have been given, but the law forbids the act.

Consent of the victim is not a defense if he or she is under age 13. A child of this age is not considered mature enough to make a responsible and wise decision about sex. A person under age 16 is also protected from those significantly older. A defendant who is in a position of authority over the victim may face special penalties.

Other factors, such as the use of alcohol or a threat or weapon aggravate an unlawful sexual conduct charge.
